How Hemp Laws Are Made (And What’s in SB3)
In Texas, here’s how the legislative process works:
- A bill is introduced in either the House or Senate.
- It goes through committee review, where members debate and may amend the bill.
- If it passes committee, it heads to the full chamber for a vote.
- If approved, the bill moves to the other chamber for the same process.
- If both chambers pass the same version, it’s sent to the Governor.
At that point, the Governor can:
- Sign it, and the bill becomes law
- Veto it, and the Legislature can attempt an override with a two-thirds majority
- Take no action, and the bill becomes law without a signature (after 10 days during session or 20 days after adjournment)
Senate Bill 3 (SB3) proposes a sweeping change. It would ban hemp-derived products intended for consumption if they contain any detectable THC. This would significantly impact:
- THCa flower
- Various hemp-derived extracts and products
- The entire legal hemp supply chain in Texas
In effect, SB3 would establish a broad THC ban, reshaping the market overnight.
Earlier in the session, House Bill 28 (HB28) offered a more balanced approach, one focused on regulation over eradication. HB28 would have established:
- A 10 mg THC per serving cap
- Prohibitions on synthetic cannabinoids
- Regulatory oversight for hemp beverages under the TABC
This approach reflected broad public sentiment. Texans across the political spectrum support safe, legal cannabis access. HB28 demonstrated that it is possible to regulate the market without dismantling it entirely.
Unfortunately, HB28 stalled in committee, and SB3 advanced instead, despite clear bipartisan public support for sensible regulation.
What’s Next: Governor’s Decision and The Bigger Picture
SB3 is now on Governor Abbott’s desk. He has until June 22 to:
- Sign it, making it law
- Veto it, sending it back to the Legislature
- Take no action, allowing it to become law without signature
If the Governor signs the bill, it would become law, effective September 1, 2025. Under SB3, any product containing greater than zero percent THC would be prohibited, and the bill would also restrict the ability to ship such products into Texas.
Should SB3 be enacted, there is potential for legal challenges and implementation delays. Industry groups have already signaled plans to contest the law on constitutional and interstate commerce grounds, and it is possible that litigation could delay enforcement. In other states, similar THC ban proposals have faced resistance. For example, Florida Governor Ron DeSantis recently vetoed a comparable bill after public pushback.
